1. Subject and general terms of the Agreement
1.1. This Agreement is a public offer, and if the conditions set out below are accepted, a user who accepts this offer pays for the services purchased on the
emotion.club website (hereinafter referred to as the website) established by Sunshine Studio LLC (hereinafter referred to as Emotion.club) in accordance with the terms of this public offer. At the same time, payment for services by the user is an acceptance of the offer, which is considered equivalent to the conclusion of an Agreement on the conditions set forth in the offer (hereinafter referred to as the Agreement).
1.2. This Agreement is addressed to users who have reached the age of 18 and is an official and public offer of Emotion.club to conclude an Agreement. Access to payment for services on the site by any person under the age of 18 is strictly prohibited. By paying for the services of Emotion.club, the user declares and guarantees that his age is at least 18 years old.
1.3. If the user provides his personal data, he confirms his consent to the collection, storage and processing (accumulation, storage, clarification, use, destruction) of personal data. Such consent is provided for the entire duration of this Agreement. The user’s payment card data are not personal data and are not subject to collection, storage and processing by Emotion.club.
1.4. This Agreement, in whole or in part, may be changed by Sunshine Studio LLC at any time without any special notice to users. The new version of the Agreement comes into force from the moment of its publication on the website.
2. Payment for services Emotion.club
2.1. Payment for the services of Emotion.club is made by the user by transferring funds using payment systems, as well as by cash. Payment for services can be made as a one-time online payment in the amount of the full cost of services, and a partial advance online payment, while the remainder of the cost of the service must be paid by the user on the spot before the start of the service. To pay for services, the user must follow the instructions on the website.
2.2. Emotion.club has the right at any time after the publication of this Agreement to unilaterally change the list of payment systems, reflecting the specified changes on the website. All risks and adverse consequences associated with payment for Emotion.club services through other payment systems are borne by the user.
2.3. The cost of services is fixed in EURO at the time of payment or prepayment. Payment is made by the user or third parties on behalf of the user in euros at the rate used by the payment system.
2.4. In order to avoid any kind of misunderstanding, Emotion.club hereby declares and warns users that payment systems may charge any kind of commissions and fees in excess of the cost of the service object, setting the condition of acceptance when such commissions and fees are paid by the user. These commissions and fees are non-refundable. The user who made the acceptance is considered warned and agrees with this condition.
2.5. Tours to the Vatican Museums and the Colosseum require advance purchase of group admission tickets. According to the rules of the Vatican and the Colosseum, entrance group tickets are strictly tied to the date and time of entry, are NOT divisible and are NOT refundable. In this regard, the user can enter the Vatican Museums and the Colosseum only as a part of the relevant guided group.
2.6. Cancellation for participation in our tours without penalties is possible no later than 24 hours before the start of the service for Vatican tours and 7 days before the start of the service for Colosseum tour. The full or advance payment will be returned in full.
2.7. Tours are conducted in all weather conditions. In case of heavy rain, Emotion.club reserves the right to slightly change the route, where possible, in order to spend part of the tour time indoors.
2.8. If, for reasons beyond the control of Emotion.club, circumstances that do not allow Emotion.club to properly fulfill its obligations to implement the service, Emotion.club reserves the right to replace part of the range of services (for example, during a food tour, replacing one restaurant with another) while maintaining the class and quality of the service or providing a higher class service without additional payment.
2.9. The User has the right to send all claims for improper provision of services to the email

2.10. The User is fully responsible for the accuracy of the information and data specified when registering on the Site and paying for services.
3. Responsibility and guarantees
3.1. Emotion.club is not responsible for violation of the terms of this Agreement if such a violation is caused by force majeure circumstances, including: actions of state authorities, fire, flood, earthquake, other acts of God, lack of electricity and/or malfunctions computer network (disruption of communication lines, equipment malfunction, etc.), illegal actions of third parties aimed at violating information security or the normal functioning of the site, strikes, civil unrest, riots, any other circumstances, not limited to those listed above, that may affect the implementation of the terms of this Agreement by Emotion.club and beyond the control of Emotion.club.
3.2 Emotion.club strongly recommends that users take out travel insurance in case of cancellations and delays due to unforeseen circumstances or beyond the control of circumstances (eg inclement weather, strikes, seismic events). Users are also advised to take out medical and personal insurance in advance to cover any medical expenses, loss of luggage, loss of personal belongings or other similar accidents while traveling. Users agree that neither Emotion.club nor any local partner operators will be held liable in any way for such unforeseen circumstances. All claims for reimbursement of insurance costs must go directly through the insurance provider and not through Emotion.club.
3.3 During food tours, all responsibility for consumed drinks and food rests with the user. If the user has any special dietary or gastronomic preferences, he is advised to inform Emotion.club in advance. Unfortunately our food tours are not suitable for users with gluten intolerances. If a suer has any allergies or any kind of intolerances to any product, he is strongly advised to check with the guide for the likelihood of its presence before proceeding to consumption. By paying for Emotion.club food tours, the user agrees with this Agreement, which makes the tour participant responsible for the products consumed.
3.4 All disputes arising from legal relations under this Agreement shall be resolved through negotiations. In the event that the Parties do not come to a solution to the disputes that have arisen between them during the negotiations, such disputes must be referred to the appropriate court of the United States of America at the location of Emotion.club with the obligatory observance of the claim procedure. The term for responding to a claim is 1 (one) month.
